Terms and conditions of sale of the web store
The Baltic Bolt Web Store has the right to unilaterally change and amend the terms and conditions by publishing the new terms and conditions at the Internet address www.balticbolt.ee. In addition to the terms and conditions purchases in the Baltic Bolt Web Store are regulated by legal instruments in force in the Republic of Estonia.
The terms and conditions of sale apply to purchase of the goods in the Baltic Bolt Web Store. The prices of the products sold in the Baltic Bolt Web Store are displayed near the products. All prices include the value added tax of 20%. The charge for delivery of the goods is added to the price. The charge for delivery of the goods depends on location of the buyer and on the delivery method. The delivery charge is shown to the Buyer when the Buyer completes his or her order. Information about the goods is displayed in the Baltic Bolt Web Store near the respective goods. Information about products is checked and updated on a regular basis. Images of products are of an illustrative nature.
When the Buyer orders the goods, he or she must add the desired products to the basket. To submit the order all required data fields must be completed, and a suitable method of delivery of the products must be selected. After that the amount of the charge is displayed on the screen, and this amount must be paid via a bank link or using another payment solution. The contract enters into effect from the time when the amount due to be paid is transferred to the settlement account of the Baltic Bolt Web Store. The Baltic Bolt Web Store reserves the right to cancel the order without notifying the Buyer thereof, if necessary. All goods are available subject to their physical availability in stock. The Baltic Bolt Web store has the right to withdraw from the contract if delivery of the ordered goods was impossible because the goods ran out of stick, or due to any other reason. The Baltic Bolt Web Store informs the Buyer of withdrawal from the contract at first opportunity via telephone or e-mail. If the Buyer has already paid for the ordered goods, the Baltic Bolt Web Store returns the amount of the purchase price (including the charge for delivery of the product) to the Buyer promptly, however, not later than within 14 days. Orders submitted in the Baltic Bolt Web Store are processed on working days (Mo.-Fr.) from 9:00 to 17:00. Orders submitted on Saturdays, Sundays, and national holidays are processed on the following working day.
The goods are sent within the borders of Europe. The goods can be ordered to a physical store of Baltic Bolt, to a parcel machine of a selected service provider, or to the address stated by the customer using the courier service. Costs of delivery of the goods are borne by the Buyer, and the respective price information is displayed near the delivery method. Packages within Estonia normally reach the destination point stated by the Buyer within 1-4 business days from the time of entry of the sale contract into effect. Delivery of the goods outside Estonia is completed within 3-7 working days. In exceptional cases the Baltic Bolt Web Store reserves the right to deliver the goods within 45 calendar days. In physical stores of Baltic Bolt the goods are handed over during business hours of a respective store. In physical stores the goods are handed over on the basis of a personal identification document (ID-card, passport, driver’s licence) and the order number. In case of absence of a personal identification document Baltic Bolt can refuse to hand the goods over. Baltic Bolt is not liable for any damage caused to the customer, if due to reasons not arising from Baltic Bolt, third persons gained possession of a copy of the invoice or unique order number, and were able to receive the goods on their basis.
After receipt of the order the Buyer has the right to withdraw from the contract concluded with the Baltic Bolt Web Store within 14 days. The right of withdrawal does not apply to the Buyer who is a legal entity. The 14-day right of return cannot be exercised if the ordered goods were used in a manner other than the one necessary to ascertain the nature, properties and operation of the goods in the same acceptable way as when the goods are tested in a physical store. The returned product must be in the original packaging, have the original marking and be in the same set that it was in when it was handed over to the Buyer. If the packaging of the goods can be opened without damaging the packaging, the Buyer undertakes to open it in such manner. Items attached to the goods for protection of their condition (such as protective film) that do not hinder testing and inspection of the product, must be removed at the time of return. If the goods were used for the purpose other than the one necessary to ascertain the nature, properties and operation of the goods, or if the goods have signs of use or wear, the Baltic Bolt Web Store has the right to reduce the returned amount of payment in accordance with reduction in the value of the goods. To return the goods the Buyer must submit an application for withdrawal from purchase of the goods (opens here) , by sending it to e-mail address epood@balticbolt.ee not later than within 14 days following receipt of the goods. Costs of return of the goods are borne by the Buyer, except where the reason for return is that the item subject to return does not correspond to the order (for example, an incorrect or defective item was sent). The Buyer must return the goods within 14 days following the time of submission of the application, or the Buyer must submit a notice proving that the Buyer handed the goods over to the transport company within this period. When the Baltic Bolt Web Store receives the returned goods, it refunds to the Buyer the amount of the purchase price together with the delivery charge promptly, however, not later than within 14 days following receipt of the application for withdrawal. Money is refunded to the same settlement account from which the purchase was paid for. The Baltic Bolt Web Store can refuse to refund the money until the item that is the subject of the contract was received by the Baltic Bolt Web Store, or until the Buyer presented proof that the Buyer sent the item back, whichever happens earlier. If the Buyer explicitly chose a delivery method that differs from the cheapest usual delivery method offered by the Baltic Bolt Web Store, the Baltic Bolt Web Store does not have to refund to the consumer those expenses that exceed expenses related to a usual delivery method. The Baltic Bolt Web Store has the right to withdraw from the sale transaction and demand the goods back from the Buyer, if the price of the goods displayed in the Web Store was significantly lower than the market price of the goods.
The Baltic Bolt Web Store is liable for non-correspondence of the goods sold to the Buyer to the terms and conditions of the contract or for defects that existed already at the time of handover of the item or which appeared within up to two years starting from the time of transfer of the goods to the Buyer. Within the first six months following the time of handover of the item to the Buyer it is assumed that the defect existed already at the time of the handover. Rebuttal of such assumption is the obligation of the Baltic Bolt Web Store. If results of a diagnostic test show that the defect was caused by a mistake of the consumer, the Baltic Bolt Web Store can arrange for the Buyer repair for a fee or send the product back to the Buyer. If the Buyer does not agree with the results of the diagnostic test, the Buyer has the right to obtain another opinion, the costs of which are initially borne by the Buyer. After expiry of the six-month period from the time of purchase of the goods the Buyer has to prove that the given defect is a manufacturing defect, and not a defect that was caused by incorrect use of the item by the consumer. The Buyer organises the diagnostic test using own resources, and sends the work completion certificate prepared on the basis of the results of the diagnostic test to the Baltic Bolt Web Store. If the Baltic Bolt Web Store does not agree with the conclusions of the work completion certificate, the Baltic Bolt Web Store has the right to organise another expert assessment, the costs of which are initially borne by the Baltic Bolt Web Store. Claims can be resolved by a partial compensation, or by a buyback, exchange or repair of the product. The Baltic Bolt Web Store is not liable for worsening/damage of the product caused by the Buyer; defects that resulted from the use of the product not according to the designated use; normal physical wear of the product. In case of discovery of a defect the Buyer has the right to turn to the Baltic Bolt Web Store not later than within two years, by sending an e-mail to the address epood@balticbolt.ee or calling number 650 8967. The Baltic Bolt Web Store is not liable for any defects that appeared after handover of the goods to the Buyer. If the goods purchased from the Baltic Bolt Web Store have defects for which the Baltic Bolt Web Store is liable, the Baltic Bolt Web Store repairs or replaces the defective goods. If the goods cannot be repaired or replaced, the Baltic Bolt Web Store returns to the Buyer all payments made on the basis of the sale contract. The Baltic Bolt Web Store responds to a complaint submitted by the consumer in writing or in a format which can be reproduced in writing within 15 days.
The Baltic Bolt Web Store uses the personal data entered by the Buyer (including name, telephone number, address, e-mail address, bank details) in accordance with the Personal Data Protection Act only for the purpose of processing of the order or sending of the goods to the Byer. The Baltic Bolt Web Store communicates personal data to the company that provides transport services for the purpose of delivery of the goods. The Baltic Bolt Web Store does not have access to bank details of the customer. The Buyer has the right to forbid collection and use of his or her personal data, except where it is necessary to recover a claim arising from the contract or to deliver the goods.
If the Buyer has any claims against the Baltic Bolt Web Store, they must be sent to e-mail address epood@balticbolt.ee. The parties try to resolve all disputes arising from performance of the contract by way of negotiations. If the parties fail to reach an agreement, the disputes are resolved in court by way of a judicial procedure according to legal instruments in force in the Republic of Estonia. In order to resolve disputes by way of an extrajudicial procedure, the Buyer has the right to turn to the Consumer Disputes Committee of the Consumer Protection Board. Exercise of the right to turn to the Consumer Disputes Committee does not deprive the Buyer of the right to turn to court for resolution of the dispute. The Buyer can familiarise himself or herself with the conditions of the procedure and submit an application here. The Consumer Disputes Committee has competence for resolution of disputes arising from the contract concluded between the Buyer and Baltic Bolt Web Store. Review of a complaint of the Buyer by the Committee is free of charge. The Buyer can turn to the Online Dispute Resolution platform of the European Union. |
